These Terms of Service ("Terms") govern your use of the Fivebalance mobile app and platform, a product of FivebalanceUSA.LLC ("Company", "we", "us", or "our"). FivebalanceUSA® is a registered trademark of FivebalanceUSA.LLC.
1. Acceptance of Terms
By accessing or using Fivebalance, you agree to be bound by these Terms. If you do not agree, do not use the service. You must be 18 years of age or older to use this platform.
2. Description of Service
Fivebalance is a social media and mental wellness platform that helps users set and achieve goals across five life categories: Fitness, Faith, Family, Flair, and Financial. The platform includes goal tracking, community features, FivebalanceTV, a wellness library, and FBN token rewards.
3. Subscriptions and Billing
FivebalanceTV access requires an active subscription at $40.00/year. Subscriptions auto-renew unless cancelled before the renewal date. All prices are in USD.
4. User Conduct
You agree not to:
- Post harmful, abusive, or misleading content
- Impersonate other users or create multiple accounts
- Use the service for any unlawful purposes
- Harass, threaten, or harm other users
- Attempt to exploit or manipulate the platform or token reward system
5. FBN Token Rewards
FBN tokens are earned as rewards for completing wellness goals on the platform. FBN tokens are utility tokens and do not constitute investment advice, securities, or financial instruments. The purchase or receipt of FBN tokens does not give the user any voting rights or ownership of FivebalanceUSA.LLC. FivebalanceUSA.LLC makes no inference that FBN tokens will go up or down in value.
6. WFBN Token
The purchase of $WFBN Tokens does not give the user any voting rights or any ownership of FivebalanceUSA.LLC. Purchasing $WFBN Tokens is purely for the purposes stated in the WFBN documentation. Transactions involving $WFBN occur on the Solana blockchain via decentralized exchanges. Decentralized exchanges are not U.S. regulated exchanges. FivebalanceUSA.LLC makes no inference that $WFBN will go up or down in value. As always, please do your own research and consult with a licensed financial advisor for any investment advice.
7. Content and Intellectual Property
All platform content, articles, wellness programming, and FivebalanceTV content are the property of FivebalanceUSA.LLC. User-generated content remains the property of the user, but you grant us a license to display it on the platform.
8. Medical Disclaimer
The Fivebalance mobile app is not an approved FDA medical device nor does it proclaim to be. Information obtained in the Fivebalance mobile app, on Fivebalance.com, or on its affiliated social media sites is for informational purposes only and is not to be taken as medical advice.
9. Disclaimer of Warranties
Fivebalance is provided "as is" without warranties of any kind. We do not guarantee the accuracy of any content on the platform. This platform is for educational and informational purposes only and does not constitute financial, investment, or legal advice.
10. Limitation of Liability
FivebalanceUSA.LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to financial losses from crypto investments.
11. Trademark
FivebalanceUSA® is a registered trademark of FivebalanceUSA.LLC (U.S. Patent and Trademark Office Registration No. 7302623). Unauthorized use of this trademark including in mobile apps, software, branding, or related services is strictly prohibited and may result in legal action for infringement under U.S. trademark law (15 U.S. Code § 1114).
